Data Processing Agreement

1. Definitions

Capitalized terms not defined in this DPA have the meanings set forth in the Terms of Service.

• "Personal Data" means any information relating to an identified or identifiable natural person.
• "Processing" has the meaning given to it under applicable data protection laws.
• "Controller" and "Processor" have the meanings given to them under applicable data protection laws.

2. Scope and Roles of the Parties

2.1 User as Controller

The User is the Controller of Personal Data submitted to or processed through the Service by the User.

2.2 TypeBeat.Fun as Processor

TypeBeat.Fun acts as a Processor of Personal Data contained within User Content solely for the purpose of providing the Service in accordance with the User's instructions.

TypeBeat.Fun processes Personal Data only to:

• Host and store User Content
• Display User Content within the User's producer profile and catalog pages on the TypeBeat.Fun platform
• Perform technical operations necessary to operate, secure, and maintain the Service (e.g., backups, analytics, and performance optimization)

2.3 TypeBeat.Fun as Controller (Account & Billing Data)

TypeBeat.Fun acts as an independent Controller of Personal Data relating to User account registration, subscription administration, and customer support.

TypeBeat.Fun acts as Controller solely for:

• Account creation and authentication
• Subscription management and billing administration
• Customer support communications
• Legal and compliance obligations

3. Payment Data Disclaimer

All payments for beats or licenses are processed directly by the User through third-party payment providers selected by the User. TypeBeat.Fun does not receive, store, or process buyer payment information related to such transactions.

4. Processing Details

4.1 Subject Matter

The subject matter of the Processing is the provision of the TypeBeat.Fun software platform.

4.2 Duration

Processing will continue for the duration of the User's use of the Service, unless otherwise required by law.

4.3 Nature and Purpose

The nature and purpose of Processing is to provide SaaS features such as content management, profile display, analytics, and related technical operations.

4.4 Categories of Data Subjects

• Users of the Service
• Individuals whose personal data is included in User Content (if applicable)

4.5 Categories of Personal Data

• Account information (name, email address)
• Profile information voluntarily provided by the User
• Technical and usage data

5. Subprocessors

The User authorizes TypeBeat.Fun to engage subprocessors to assist in providing the Service (e.g., cloud hosting, analytics, email delivery), provided that such subprocessors are subject to appropriate data protection obligations.
